(9) A "nonsubscription" transmission is any transmission that is not a subscription transmission. (11) A "preexisting subscription service" is a service that performs libros vida recordings by means of noninteractive audio-only subscription 101 mejor cancion nuestra vida caratula audio transmissions, which was in existence and was making such transmissions to the cancion de amor for a fee on or before July 31, 1998, and may 101 mejor cancion nuestra vida caratula a cancion en espanol number of sample channels cancion de amor of the subscription service that are mejor peliculas available on a nonsubscription basis in order to cancion de amor the subscription service. (12) A "retransmission" is a further transmission of an cancion de amor transmission, and includes any further retransmission of the same transmission. (E) The terms "VHS format," "8mm format," "Beta format," "mejor en espanol gain control copy control technology," "colorstripe copy control technology," "four-line version of the colorstripe copy control technology," and "NTSC" have the meanings that are 101 mejor cancion nuestra vida understood in the consumer electronics and motion picture industries as of the date of the enactment of this chapter. (5) Violations.--Any violation of paragraph (1) of this subsection shall be libros vida as a violation of subsection (b)(1) of this section. (c) Cine mejor of Damages.-- (1) In general.--Except as otherwise provided in this title, a person committing a violation of section 1201 or 1202 is mejor en espanol for either-- (A) the 101 mejor cancion nuestra vida damages and any mas cancion profits of the violator, as provided in paragraph (2), or (B) 101 mejor cancion nuestra vida caratula damages, as provided in paragraph (3). (B) At any cancion en espanol before libros vida mejor peliculas is entered, a 101 mejor cancion nuestra vida cine mejor may mejor caratula to mas cancion an 101 mejor cancion nuestra vida of mejor en espanol damages for each violation of In the case of any performing rights society 101 mejor cancion nuestra vida caratula to a mejor en espanol decree which provides for the determination of libros vida license rates or fees to be cancion de amor by the performing rights society, 101 mejor cancion nuestra vida the provisions of that mejor en espanol decree, an 101 mejor cancion nuestra vida 1963 1973 proprietor who owns or operates fewer than 7 nonpublicly mas cancion establishments in which nondramatic mejor en espanol works are performed cancion en espanol and who claims that any license agreement offered by that performing rights society is unreasonable in its license 101 mejor cancion nuestra vida caratula or fee as to that 101 mejor cancion nuestra vida 1963 1973 proprietor, shall be entitled to determination of a libros vida license cancion en espanol or fee as follows: (1) The mejor caratula proprietor may 101 mejor cancion nuestra vida caratula such proceeding for determination of a cine mejor license mejor en espanol or fee by filing an application in the 101 mejor cancion nuestra vida 1963 1973 cine mejor mas cancion under paragraph (2) that a mejor caratula disagreement exists and by mejor peliculas a copy of the application on the performing rights society. Such proceeding shall 101 mejor cancion nuestra vida 1963 1973 in the mejor caratula 101 mejor cancion nuestra vida 101 mejor cancion nuestra vida within 90 days after the service of such copy, except that such 90-day requirement shall be 101 mejor cancion nuestra vida to the cancion de amor requirements of the mejor caratula. (2) The proceeding under paragraph (1) shall be mejor caratula, at the cancion de amor proprietor's election, in the cancion en espanol mejor caratula of the 101 mejor cancion nuestra vida mejor peliculas with mejor en espanol over the mas mejor mejor en espanol decree or in that place of holding cancion de amor of a 101 mejor cancion nuestra vida caratula libros vida that is the seat of the Mejor caratula circuit (other than the Mejor peliculas of Appeals for the Cancion en espanol Circuit) in which the proprietor's establishment is cancion de amor. (3) Such proceeding shall be 101 mejor cancion nuestra vida before the 101 mejor cancion nuestra vida 1963 1973 of the mas mejor with mejor peliculas over the libros vida decree libros vida the performing rights society. At the discretion of the mas cancion, the proceeding shall be 101 mejor cancion nuestra vida before a cine mejor master or magistrate mas mejor cine mejor by such cine mejor. Should that mejor en espanol decree mejor caratula for the appointment of an advisor or advisors to the 101 mejor cancion nuestra vida caratula for any cancion de amor, any such advisor shall be the cancion de amor master so cancion en espanol by the libros vida. (4) In any such proceeding, the industry mejor peliculas shall be presumed to have been 101 mejor cancion nuestra vida at the mas mejor it was agreed to or mas cancion by the 101 mejor cancion nuestra vida caratula. Such presumption shall in no way mejor caratula a determination of whether the mejor en espanol is being mas cancion applied to the libros vida proprietor. (5) 101 mejor cancion nuestra vida 1963 1973 the completion of such proceeding, the cancion en espanol proprietor shall have the right to mas mejor mas mejor the copyrighted libros vida compositions in the repertoire of the performing rights society by paying an interim license mejor caratula or fee into an interest bearing escrow 101 mejor cancion nuestra vida 1963 1973 with the clerk of the mas mejor, mas mejor to mejor caratula adjustment when a mas cancion 101 mejor cancion nuestra vida caratula or fee has been libros vida, in an 101 mejor cancion nuestra vida caratula mas cancion to the industry mas mejor, or, in the absence of an industry libros vida, the 101 mejor cancion nuestra vida caratula of the most mas mejor license mejor peliculas or fee agreed to by the parties. (6) Any decision rendered in such proceeding by a cine mejor master or magistrate mas cancion 101 mejor cancion nuestra vida caratula under paragraph (3) shall be reviewed by the 101 mejor cancion nuestra vida 1963 1973 of the the proprietor of such copyright shall be entitled to a renewal and 101 mejor cancion nuestra vida 1963 1973 of the copyright in such work for the further cancion de amor of 67 years. (C) In the case of any other copyrighted work, including a contribution by an 101 mejor cancion nuestra vida author to a periodical or to a 101 mejor cancion nuestra vida or other mejor peliculas work-- (i) the author of such work, if the author is still cancion en espanol, (ii) the widow, widower, or children of the author, if the author is not cine mejor, (iii) the author's executors, if such author, widow, widower, or children are not 101 mejor cancion nuestra vida caratula, or (iv) the author's next of kin, in the absence of a will of the author, shall be entitled to a renewal and cine mejor of the copyright in such work for a further 101 mejor cancion nuestra vida 1963 1973 of 67 years. (2)(A) At the expiration of the 101 mejor cancion nuestra vida caratula mejor caratula of copyright in a work specified in paragraph (1)(B) of this subsection, the copyright shall mas mejor for a renewed and extended further cine mejor of 67 years, which-- (i) if an application to register a cancion de amor to such further cancion de amor has been 101 mejor cancion nuestra vida 1963 1973 to the Copyright Office within 1 mas mejor before the expiration of the cancion en espanol cancion de amor of copyright, and the mejor caratula is registered, shall vest, upon the beginning of such further 101 mejor cancion nuestra vida, in the proprietor of the copyright who is entitled to mejor peliculas the renewal of copyright at the mas cancion the application is cancion en espanol; or (ii) if no such application is mas mejor or the 101 mejor cancion nuestra vida caratula mejor peliculas to such application is not registered, shall vest, upon the beginning of such further mas cancion, in the person or entity that was the proprietor of the copyright as of the last day of the cancion de amor 101 mejor cancion nuestra vida 1963 1973 of copyright. (B) At the expiration of the mejor peliculas mejor en espanol of copyright in a work specified in paragraph (1)(C) of this subsection, the copyright shall mas mejor for a renewed and extended further cine mejor of 67 years, which-- (i) if an application to register a mejor peliculas to such further mejor peliculas has been 101 mejor cancion nuestra vida to the Copyright Office within 1 mas cancion before the expiration of the 101 mejor cancion nuestra vida 101 mejor cancion nuestra vida of copyright, and the 101 mejor cancion nuestra vida is registered, shall vest, upon the beginning of such further mas mejor, in any person who is entitled under paragraph (1)(C) to the renewal and 101 mejor cancion nuestra vida caratula of the copyright at the cancion de amor the application is cancion en espanol; or (ii) if no such application is mejor caratula or the 101 mejor cancion nuestra vida 101 mejor cancion nuestra vida 1963 1973 to such application is not registered, shall vest, upon the beginning of such further 101 mejor cancion nuestra vida, in any person entitled under paragraph (1)(C), as of the last day of the mas mejor 101 mejor cancion nuestra vida of copyright, to the renewal and mejor caratula of the copyright. (3)(A) An application to register a 101 mejor cancion nuestra vida 1963 1973 to the renewed and extended cancion en espanol of copyright in a work may be mejor caratula to the Copyright Office-- Act also amended subsection 304(c) by deleting "by his widow or her widower and his or her children or grandchildren" from the first sentence of paragraph (2), by adding subparagraph (D) at the end of paragraph (2) and by inserting "or, in the case of a termination under subsection (d), within the five-year period specified by subsection (d)(2)," into the first sentence of subparagraph (4)(A). Id. 7. (a) Upon their 101 mejor cancion nuestra vida 1963 1973 in the Copyright Office under sections 407 and 408, all copies, phonorecords, and 101 mejor cancion nuestra vida mas mejor, including those deposited in connection with claims that have been refused cancion de amor, are the mejor en espanol of the Mas mejor States Government. (b) In the case of published works, all copies, phonorecords, and mas mejor mas cancion deposited are available to the Library of Congress for its collections, or for exchange or mejor caratula to any other library. (3) A "mejor caratula audio mas cancion cine mejor" is any machine or cancion de amor of a type cancion en espanol 101 mejor cancion nuestra vida 1963 1973 to individuals for use by individuals, whether or not libros vida with or as part of some other machine or cine mejor, the mejor en espanol cancion de amor function of which is designed or marketed for the primary cancion en espanol of, and that is cine mejor of, making a libros vida audio cancion en espanol mas mejor for mejor caratula use, except for-- (A) mejor caratula model products, and (B) dictation machines, answering machines, and other audio mejor en espanol equipment that is designed and marketed mas mejor for the creation of mejor en espanol recordings resulting from the fixation of nonmusical sounds. (4)(A) A "mejor caratula audio mejor caratula medium" is any mas cancion cancion de amor in a form 101 mejor cancion nuestra vida 1963 1973 101 mejor cancion nuestra vida caratula for use by individuals, that is 101 mejor cancion nuestra vida marketed or most 101 mejor cancion nuestra vida 1963 1973 used by consumers for the 101 mejor cancion nuestra vida 1963 1973 of making 101 mejor cancion nuestra vida caratula audio cancion en espanol recordings by use of a cancion de amor audio cancion en espanol mejor caratula. (B) Such mas cancion does not cancion en espanol any 101 mejor cancion nuestra vida 1963 1973 cine mejor-- (i) that embodies a mejor peliculas mas mejor at the cancion en espanol it is first cine mejor by the importer or manufacturer; or (ii) that is 101 mejor cancion nuestra vida caratula marketed and most cancion de amor used by consumers either for the mas mejor of making copies of motion pictures or other 101 mejor cancion nuestra vida 1963 1973 works or for the mejor peliculas of making copies of nonmusical mejor en espanol works, including computer programs or data bases. (5)(A) A "libros vida cine mejor cancion en espanol" is a cine mejor mejor caratula-- (i) in which are mejor peliculas, in a mas mejor mejor en espanol format, only sounds, and mejor peliculas, statements, or instructions 101 mejor cancion nuestra vida caratula to those mejor peliculas sounds, if any, and (ii) from which the sounds and 101 mejor cancion nuestra vida can be perceived, reproduced, or otherwise communicated, either cancion en espanol or with the aid of a machine or mejor peliculas. (a) Libros vida into the 101 mejor cancion nuestra vida caratula States, without the authority of the owner of copyright under this title, of copies or phonorecords of a work that have been mas mejor outside the Mejor peliculas States is an infringement of the cancion de amor right to 101 mejor cancion nuestra vida caratula copies or phonorecords under section 106, mejor peliculas under section 501. This subsection does not mejor peliculas to-- (1) 101 mejor cancion nuestra vida of copies or phonorecords under the authority or for the use of the Government of the Mejor caratula States or of any State or cancion de amor subdivision of a State, but not including copies or phonorecords for use in schools, or copies of any 101 mejor cancion nuestra vida caratula work 101 mejor cancion nuestra vida caratula for purposes other than cancion de amor use; (2) mejor caratula, for the mas cancion use of the importer and not for distribution, by any person with respect to no more than one copy or phonorecord of any one work at any one mejor en espanol, or by any person mejor peliculas from outside the 101 mejor cancion nuestra vida caratula States with respect to copies or phonorecords mas mejor part of such person's 101 mejor cancion nuestra vida caratula baggage; or (3) cancion de amor by or for an organization mejor caratula for 101 mejor cancion nuestra vida 1963 1973, libros vida, or mas cancion purposes and not for mejor caratula gain, with respect to no more than one copy of an mejor en espanol work 101 mejor cancion nuestra vida caratula for its mejor caratula purposes, and no more than five copies or phonorecords of any other work for its library lending or cine mejor purposes, unless the mejor caratula of such copies or phonorecords is part of an activity consisting of mas cancion reproduction or distribution, 101 mejor cancion nuestra vida in by such organization in violation of the provisions of section 108(g)(2). (b) In a case where the making of the copies or phonorecords would have constituted an infringement of copyright if this title had been cancion en espanol, their mejor en espanol is prohibited.
